1. Overview

This website (homeandhardwaremegastore.com, the "Site") is operated by Home & Hardware Megastore, Monkey Stand New Rd, Marnamikatta, Mangala Nagar, Mangalore, Karnataka 575001 ("we", "us", "our"). By visiting the Site or purchasing from us, you agree to these Terms of Service ("Terms") together with our Privacy Policy, Shipping & Delivery Policy and Return & Refund Policy. If you do not agree, please do not use the Site. We may update these Terms from time to time by posting the revised version here; continued use of the Site after changes are posted constitutes acceptance.

2. Eligibility & account

By ordering, you confirm you are at least 18 years old (or ordering with the consent of a guardian) and that the information you provide — including delivery address and phone number — is accurate. You are responsible for keeping your account credentials confidential and for all activity under your account.

3. Products, pricing and availability

All prices are in Indian Rupees and are inclusive of GST unless stated otherwise. A GST invoice is issued with every order.
Prices and stock reflect our physical store and can change without notice. If a pricing or stock error affects your order, we will contact you to re-confirm or cancel with a full refund.
Product images are indicative. Natural materials (wood, stone finishes) and manufacturer batches (paint shades, tiles, cement) can vary; specifications given by manufacturers may change.
Variant products (size, thickness, colour, length) are charged at the price of the specific variant selected.

4. Orders and payment

An order is accepted when we confirm it; we may refuse or cancel any order (for example, suspected fraud, pricing error, or non-serviceable address) with a full refund of any amount paid.
We accept Cash on Delivery and online payment through our payment gateway partner(s). Online payment data is processed by the payment gateway; we do not store your card or UPI credentials.
For Cash on Delivery, please keep the payable amount ready; our delivery agent completes handover against the delivery OTP.

5. Delivery

Delivery is made by our own team to serviceable pincodes as described in our Shipping & Delivery Policy. Risk in the goods passes to you on delivery. Please inspect goods at the time of delivery, before confirming receipt with the OTP.

6. Returns

Returns and refunds are governed by our Return & Refund Policy, which forms part of these Terms.

7. Bulk & trade orders

Trade, contractor and project-quantity pricing shown on the Site applies to the quantities stated. For very large requirements, quoted terms (including delivery schedule and payment terms) agreed in writing with us prevail over standard Site terms for that order.

8. Acceptable use

You agree not to use the Site for any unlawful purpose, attempt to gain unauthorised access to it, scrape or copy its content for commercial use, or transmit malicious code. We may suspend access for breach of these Terms.

9. Intellectual property

The Site's content — text, layout, graphics and our name and logo — belongs to us or our licensors. Manufacturer brand names and logos belong to their respective owners and are used to identify genuine products we stock.

10. Limitation of liability

To the maximum extent permitted by law, our liability for any claim relating to an order is limited to the amount paid for that order. We are not liable for indirect or consequential losses, including project delays. Nothing in these Terms limits rights you have under applicable consumer protection law, including the Consumer Protection Act, 2019.

11. Force majeure

We are not responsible for delay or failure caused by events beyond our reasonable control (including weather, strikes, transport disruption, or regulatory action); we will fulfil affected orders as soon as reasonably possible or refund them.

12. Governing law and jurisdiction

These Terms are governed by the laws of India. Courts at Mangalore, Karnataka shall have exclusive jurisdiction, subject to any rights you may have under consumer protection law.
